Article 1 – Introduction and Scope

These General Terms and Conditions of Sale and Use (hereinafter "GTC/GTU") govern access to and use of the website www.seat-ventilation.com, as well as all commercial transactions carried out through it.

By accessing the site and placing an order, the user acknowledges having read these GTC/GTU and accepts them without reservation. Any use of the site implies full and unreserved acceptance of these terms. Users who do not accept these terms are invited not to use the site.

These GTC/GTU apply to all orders placed on the site, whether by a professional buyer (B2B) or a consumer within the meaning of the preliminary article of the French Consumer Code (B2C).

Article 3 – Products and Services Offered

The products and services offered on www.seat-ventilation.com are described as accurately as possible. However, SEAT Ventilation cannot be held liable for any errors or omissions. Product photographs displayed on the site are purely illustrative and are not contractually binding.

SEAT Ventilation reserves the right to modify its product and service catalogue at any time without prior notice.

Article 4 – Orders

4.1 Placing an Order

Users may place orders by selecting the desired products or services and following the online ordering process. The order will only be definitively confirmed upon payment confirmation. A confirmation email summarising the order details will be sent to the email address provided by the user.

4.2 Product Availability

Products offered are subject to stock availability. In the event of total or partial unavailability after order confirmation, SEAT Ventilation will notify the customer by email as soon as possible. The customer may then choose to: cancel the order and receive a full refund of amounts paid, or select a substitute product.

4.3 Prices

Product prices are stated in euros (€), inclusive of all taxes (VAT included), unless explicitly stated otherwise. SEAT Ventilation reserves the right to change its prices at any time; products will be invoiced based on the rates in force at the time the order is confirmed. Delivery charges are shown separately and are added to the product price in the order summary.

4.4 Payment Methods

Payment is made online, exclusively by the following means: bank card, PayPal, or any other payment method indicated on the site. Payments are secured by an encryption system complying with current banking standards (SSL/TLS protocol). SEAT Ventilation does not store any banking data on its servers.

4.5 Order Refusal

SEAT Ventilation reserves the right to refuse any order for legitimate reasons, particularly in the event of an existing dispute with the buyer, prior payment default, or an abnormal request.

Article 5 – Delivery

5.1 Delivery Terms

Ordered products are delivered to the address provided by the user when placing the order. SEAT Ventilation cannot be held liable for delivery delays attributable to the carrier, a case of force majeure, or incorrect delivery information provided by the user.

5.2 Delivery Times

Delivery times are given as an indication at the time of ordering. In accordance with Article L.216-1 of the French Consumer Code, in the absence of any indication or agreement regarding the delivery date, SEAT Ventilation will deliver within thirty (30) days from the conclusion of the contract.

5.3 Delivery Charges

Delivery charges are calculated based on the weight, volume of the products, and destination. They are clearly displayed before the final order confirmation and are the responsibility of the buyer, unless a promotional offer states otherwise.

5.4 Retention of Title

SEAT Ventilation retains ownership of sold products until full payment of the price, including principal and accessories, has been received. Accordingly, if the buyer is subject to collective insolvency proceedings, SEAT Ventilation reserves the right to reclaim unpaid products.

Article 6 – Right of Withdrawal (Consumers Only)

In accordance with Articles L.221-18 et seq. of the French Consumer Code, any consumer has fourteen (14) calendar days from receipt of the products to exercise their right of withdrawal, without having to justify their decision or incur any penalties.

To exercise this right, the user must notify SEAT Ventilation by email or using the withdrawal form available on the site (compliant with the standard form set out in the annex to Directive 2011/83/EU), before the above deadline expires.

Products must be returned in their original condition, complete, in their original packaging, to the address indicated in the returns policy. Return shipping costs are the responsibility of the buyer, unless otherwise indicated. Refunds will be made within a maximum of fourteen (14) days following receipt of the returned products.

⚠️  The right of withdrawal does not apply to contracts concluded between professionals (B2B).

Article 7 – Statutory Guarantees

All products sold on the site benefit from:

• The statutory guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code): 2 years from delivery of the goods;
• The statutory guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code): 2 years from discovery of the defect.

These guarantees are without prejudice to any commercial warranty that may be granted by SEAT Ventilation or the product manufacturer.

Article 8 – Limitation of Liability

SEAT Ventilation endeavours to ensure the permanent availability and quality of the services provided on the site. However, its liability cannot be engaged in the event of:

• Temporary unavailability of the site for maintenance reasons or technical issues beyond its control;
• Indirect damages resulting from use of the site;
• Force majeure within the meaning of Article 1218 of the French Civil Code.

In any event, SEAT Ventilation's total liability, for all causes combined, is strictly limited to the pre-tax amount paid by the customer for the order concerned.

SEAT Ventilation cannot be held liable for loss of business, loss of production, loss of profit, or any indirect damage suffered by the customer.

As the products offered by SEAT Ventilation are technical equipment, it is the customer's responsibility to verify their suitability for the intended use. SEAT Ventilation cannot be held liable for misuse, non-compliant installation, or use under abnormal conditions.

Article 9 – Intellectual Property

All content on www.seat-ventilation.com — texts, images, logos, videos, graphics, layout, database — is the exclusive property of SEAT Ventilation or its partners and is protected by French and international intellectual property laws.

Any reproduction, representation, modification, publication, or adaptation of all or part of these elements, by any means or process whatsoever, is prohibited without the prior written authorisation of SEAT Ventilation, under penalty of legal proceedings.

Article 10 – Personal Data Protection (GDPR)

In accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act, personal data collected on the site is processed by SEAT Ventilation as the data controller.

This data is collected for the following purposes:

• Processing and tracking orders;
• Customer relationship management;
• Sending commercial communications (subject to the user's consent).

In accordance with the GDPR, users have the right of access, rectification, erasure, portability, restriction of processing, and objection. Article 12 – Amendments to the GTC/GTU

SEAT Ventilation reserves the right to modify these GTC/GTU at any time, in particular to comply with any new applicable regulations. Amendments take effect upon publication on the site. Orders placed prior to publication remain subject to the conditions in force at the time of their confirmation.

Article 13 – Applicable Law and Dispute Resolution

These GTC/GTU are governed by French law.

In the event of a dispute relating to the formation, interpretation, or performance of these terms, the parties agree to seek an amicable solution before any legal proceedings. Failing an amicable agreement within thirty (30) days, the dispute will be brought before the competent French courts.

In accordance with Article L.612-1 of the French Consumer Code, any consumer has the right to have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of a dispute. The contact details of the competent mediator are available on the site.
